A resident in Union County is contesting a pride flag violation. The HOA issued the violation for displaying a pride flag in his front yard. The resident claims that the association is targeting him based on his sexuality.
Pride Flag Violation Raises Concerns
Nick Crowley, a longtime resident of Indian Trail, North Carolina, is challenging his homeowners association, Holly Park HOA, over a violation he received in September 2023. The HOA issued the violation for displaying a pride flag in his front yard. The association deemed it a violation of community rules that permit only the display of the American flag.
Despite the alleged violation, Crowley points out that several other homeowners in the community have different banners displayed in their front yards. This raises concerns about selective enforcement. Crowley believes that the homeowners association is unfairly singling him out because of his sexuality. He claims that the association conveys that he is not worthy or good enough to be part of the community.
Crowley asserts that the issue is not about his actions but about who he is. He also reports incidents of someone stalking his house, observing him, and subjecting him to harassment. Despite the challenges, he proudly embraces his identity.
An Ongoing Struggle
After reporting the situation to WBTV, Crowley claimed the case was closed when the story aired, highlighting other neighborhood properties displaying non-American flags. However, the issue resurfaced months later when someone began taking photos of his home and posting them online, even after he switched to a Pride American flag.
According to Crowley, the founding document of the neighborhood HOA should supersede the HOA bylaws. He argues that the founding document explicitly prohibits discrimination within the neighborhood.
Despite receiving advice to remove the flag for the sake of a child’s life, Crowley remains steadfast in his decision not to comply. The neighborhood HOA has yet to respond to inquiries from WBTV.
