One homeowner faces HOA fines for AC unit violations from 2019. The owner understandably feels angry at the immense amount of money she owes the association, having accumulated over the years.
Shocking HOA Fines for AC Unit
A nurse, Jennifer Jackson, from Charlotte, North Carolina, faced fines of $18,000 due to an issue with her air conditioning unit. Experts assert that the problem was not her responsibility. Despite this, the homeowners association, Queens Road Condominium Association, imposed daily fines of $100 starting in 2018. Jackson, residing in a one-bedroom home, received a warning before issuing the penalties.
Inspectors identified a faulty pipe as the cause of the problem. A plumber eventually resolved the issue in March 2019.
However, the fines had already accumulated to $18,000 before the HOA dropped them in 2021. Subsequently, the HOA demanded a payment of $2,000, claiming it covered late fees and maintenance costs.
In response to a legal dispute preventing her from paying outstanding costs, Jackson reluctantly wrote a check for $19,000 in September of the same year.
A Brewing Lawsuit
In 2021 and 2023, Jackson allegedly sent two checks to the organization—$7,520 and $11,220, respectively. Strangely, both checks were not cashed. Jackson, facing legal challenges, hired an attorney and covered the homeowners association’s legal fees.
Contemplating a lawsuit, she expresses concern that fees already collected may be used to cover the association’s legal costs. This will make it difficult for her to challenge the situation.
Understanding HOA Violations
It is not uncommon for homeowners to get into heated battles with their HOA over fines. Homeowners associations often have the authority to levy fines due to violations. However, enforcing these violations must follow due process. Furthermore, HOAs must practice uniform enforcement and transparency.
As of now, Jackson’s case remains up in the air. With litigation on the horizon, the homeowner and the HOA should brace for legal challenges and costs.
